GENERAL TERMS AND CONDITIONS (GTC)

I. INITIAL PROVISIONS

  1. These General Conditions concern the online sale to Customers, via the website www.bruni-home.com, of products bearing the BRUNI brand owned by Ambiente Design s.r.o.

  5. Legal Framework: These GTC are prepared in accordance with the Slovak Civil Code (Act No. 40/1964 Coll.) and the Consumer Protection Act (Act No. 108/2024 Coll.).

II. DEFINITION OF GOODS

  • Standard Goods: Items in stock, ready for immediate dispatch.
  • Made-to-Order Goods: Items manufactured specifically to the Buyer’s requirements. This includes bespoke dimensions, personalized embroidery/monogramming, and specific fabric selections (e.g., AURA and ELEIA collections).

III. CONCLUSION OF CONTRACT & PAYMENT

  1. Contract Conclusion: The purchase contract is concluded only at the moment the Seller sends a formal confirmation of receipt of the Order to the Customer's email.
  2. Prices: All prices include VAT. The price in the Order summary is binding.
  3. Discount Codes: Unless otherwise stated, discount codes cannot be combined with other offers, sales, or other discount codes.
  4. Payment: We accept Credit/Debit Cards (3D Secure), Digital Wallets (Apple Pay, Google Pay, PayPal), and Bank Transfers (100% advance payment).
  5. Retention of Title: The Goods remain the property of the Seller until the Price and all shipping costs are paid in full.
  6. Order Limits: The Seller reserves the right to place limits on the maximum quantity or total value of products that can be purchased in a single order.
  7. GTC Acceptance: The Customer must explicitly approve these GTC during the checkout process. The Seller encourages the Customer to save or print a copy of these GTC at the time of purchase.

IV. DELIVERY AND MATERIAL TOLERANCES

  1. Shipping: Standard shipping is free for orders exceeding EUR 150 within Slovakia. Other shipping costs are calculated at checkout.
  2. Timeframe: Standard items are typically produced and shipped within 30 days. Made-to-Order items may have an extended timeframe communicated during the process.
  3. Quality Standards:
    • Natural Variations: Natural fabrics (cotton, linen, silk) may exhibit minor irregularities in weaving. Such variations are a sign of authenticity and do not constitute a defect.
    • Dimensional Tolerance: A deviation of ± 3% in dimensions is considered proper performance.
    • Color Matching: Colors on screens may differ from physical textiles. While the BRUNI Swatchbook is the best reference, minor variations (up to 4%) between different dyeing batches are acceptable.

V. WITHDRAWAL AND RETURNS

  1. Right to Withdraw: For Standard Goods, consumers may withdraw within 14 days of receipt. If an order is delivered in multiple parts, the period begins from the final delivery.
  2. Exclusions (Made-to-Order): Pursuant to Section 19(1)(c) of Act No. 108/2024 Coll., withdrawal is not possible for goods made to the consumer's special requirements (bespoke sizes, monograms, or AURA/ELEIA selections).
  3. Exclusions (Hygiene): Pursuant to Section 19(1)(e) of Act No. 108/2024 Coll., withdrawal is not possible for pillows, duvets, or mattresses if the protective seal was broken after delivery.
  4. Gift Vouchers: Vouchers may only be returned for a refund until the moment of their activation (entering the code into a User Account). Once the value is used, it is non-refundable.
  5. Return Procedure: Please register your return via hello@bruni-home.com. Your request must include: (1) Order Number, (2) Reason for Return, and (3) Items being returned. We will then provide a personalized return label.
  6. Return Fee: A flat-rate fee of EUR 4.50 per package will be deducted from your refund to cover return logistics.
  7. Exchange Price Difference: In the event of a product exchange where the new item has a higher value, the Seller reserves the right to request payment of the price difference before shipping the replacement.
  8. Violation of Return Policy: If the Customer exercises the right of withdrawal in violation of the timeframes or methods indicated in this Article (e.g., returning items after 14 days or without a label), the Seller reserves the right to refuse the return and not credit the amounts.

VI. THE BRUNI SWATCHBOOK

  1. Upon purchase, the Customer receives a voucher for the value of the Swatchbook, valid for 30 days toward a future purchase of bedding.
  2. Restriction: The Swatchbook voucher cannot be redeemed for the purchase of another Swatchbook.

VII. WARRANTY AND COMPLAINTS

  1. Reporting Window: Consumers may claim defects appearing within 2 years of acceptance. In the event of defective goods, the Customer must report the defect within 24 months of its discovery by sending an email to hello@bruni-home.sk to request a repair or replacement.
  2. Care Instructions: The Seller is not liable for damage caused by improper maintenance or washing contrary to the care symbols provided with the Goods.
  3. Insignificant Defects: The Customer cannot withdraw from the contract if the defect is insignificant (e.g., minor aesthetic variations that do not affect the functionality or nature of the product).
  4. Secondary Remedies: If the Seller is unable to repair or replace the product within a reasonable timeframe, the Customer may then request a price reduction or termination of the contract.

VIII. B2B PURCHASES (NON-CONSUMERS)

For Customers purchasing via a Business ID (IČO), the 14-day withdrawal right does not apply. Claims are governed by the Commercial Code, and the Seller’s liability is limited to the Price of the Goods in the specific Order.

IX. INTELLECTUAL PROPERTY

The website, the BRUNI brand identity, all product photography, technical descriptions, and proprietary material information are the exclusive intellectual property of Ambiente Design s.r.o. Any unauthorized reproduction, distribution, or use is strictly prohibited.

X. PRIVACY

Data Protection: For all information regarding the collection and use of personal data, express reference is made to the BRUNI Privacy Policy available on the website.

XI. FINAL PROVISIONS

  1. Right to Amend: The Seller reserves the right to make changes to these General Conditions at any time. Changes are effective upon publication on the website and apply to all orders placed after the date of publication.
  2. These GTC are governed by the laws of the Slovak Republic.
  3. Out-of-court settlements can be managed via the Slovak Trade Inspection (SOI).
